1. Agreement

These terms are between you and [LEGAL ENTITY], [REGISTERED ADDRESS] ("we", "us"). By using Driving Performance, you accept them. If you do not accept them, do not use the product.

Your employer has bought your seat under a separate agreement with us. These terms govern your personal use; that agreement governs the commercial relationship. Where the two genuinely conflict on your rights as an individual, these terms govern your use.

2. What this product is

Driving Performance is an AI leadership-coaching product. Dr. B is an AI coach grounded in [AUTHOR]'s methodology. It holds coaching conversations, builds memory of what you have discussed, and reflects development patterns back to you.

What it is not, stated plainly:

• Not a medical or mental-health service. Not therapy, not diagnosis, not treatment, and not a substitute for a qualified professional.
• Not a crisis service. If you are in crisis or at risk, contact your local emergency number or a crisis line. Dr. B may recognize distress and point you toward help, but it is not a safety system and must not be relied on as one.
• Not your employer's monitoring tool. See section 6.
• Not a professional adviser. Nothing here is legal, financial, medical, or HR advice.

3. Dr. B is an AI

Dr. B is a large language model, not a person, and will say so if you ask.

AI output can be wrong, incomplete, or confidently mistaken. Coaching output is for your reflection and judgment. You are responsible for decisions you make. Do not treat Dr. B's response as a professional opinion, and apply your own judgment before acting on it, particularly for anything involving other people's employment, health, or legal position.

4. Eligibility and your account

You must be 18 or over and authorized by your employer to use the seat. Sign-in is by a one-time link or code to your work email. Keep access to that inbox secure; anyone who controls it can reach your account. Do not share your account.

Tell us promptly at [SECURITY CONTACT] if you believe someone else has accessed your account.

5. Acceptable use

Do not:

• Use the product for anything unlawful, or to harass or harm anyone.
• Enter another person's sensitive personal data. Talking about colleagues is normal and expected in coaching; recording their medical details is not.
• Try to break, overload, reverse-engineer, or circumvent the product's limits or security, or extract the underlying prompts and models.
• Resell, sublicense, or share your access.
• Use the product to build a competing service, or to train another model on its output.

We may suspend access for a serious or repeated breach. Where practical we will tell you first.

6. Confidentiality of your coaching

Your coaching content is private to you. Your employer receives aggregate reporting only, above a minimum group size, and never your conversations, memory, or individual profile. We contractually prohibit your employer from using our reporting to make employment decisions about individuals.

We access coaching content only to run and debug the service, to keep it safe, or where the law requires. The details are in the Privacy Policy.

7. Your content and your memory

You keep ownership of what you write.

You grant us the licence needed to run the service: to store your content, process it (including sending it to our AI provider to generate responses), and derive memory and development insights from it. That licence exists to deliver the product to you and ends when you delete the content or your account, except for copies in routine backups until they age out.

We do not use your coaching content to train AI models, and our AI provider does not train on it under their commercial terms.

You can correct, retire, or scope any memory item, and export or delete everything, from within the product.

8. Our content

The product, the methodology content, Dr. B's persona, and the underlying software remain ours or our licensors'. You get a personal, non-transferable right to use them while your seat is active. [CONFIRM the licence position on (AUTHOR)'s book-derived content with the author agreement.]

9. Availability

We aim to keep the product available but do not promise uninterrupted service. We may change, suspend, or discontinue features. For material reductions affecting a paid deployment, the commercial agreement governs notice. [ADD AN SLA HERE ONLY IF ONE IS COMMERCIALLY AGREED — do not imply one.]

Usage limits: to keep the service sustainable there are per-user daily and monthly limits on AI usage. Normal coaching use will not reach them.

10. Ending your access

You can stop at any time and delete your account in Settings. Your access ends if your employer's agreement ends or your seat is withdrawn; we will give you a reasonable opportunity to export your data first, unless the law prevents it.

11. Disclaimers and liability

To the extent the law allows, the product is provided "as is" without warranties of any kind. We are not liable for indirect or consequential loss, lost profits, or lost opportunity. Nothing here excludes liability for death or personal injury caused by negligence, fraud, or anything else that cannot lawfully be excluded.

Given what this product is, we specifically disclaim liability for decisions you take based on coaching output, and for outcomes in your workplace or personal life.

12. Changes

We may update these terms. For material changes we will give notice in the product or by email before they take effect. Continuing to use the product after that means you accept the updated terms.

13. Law and disputes

These terms are governed by the law of [JURISDICTION], and the courts of [JURISDICTION] have exclusive jurisdiction, without affecting your mandatory rights to bring proceedings where you live.
